Terms of Use

1. Introduction and definitions.

1.1. All these rules are applied to the Visitors of online web store (hereinafter - Website) Trollbeads-Shop.lt and its subdomains, forums, blogs or other websites directly related, such as Facebook.com, Twitter.com etc.

1.2. In these rules, using the web-Trollbeads Shop.lt means all and any actions and the performance of online Visitor connected to the site by using an Internet connection. Within the meaning of these rules, services include all and any Visitor's actions, he can perform in the Website, including but not confining the use of the communication in forum, an interactive communication ("chat"), reading the information published, writing comments and feedback, presenting and acquiring any kind of information and (or) data and other (hereinafter - Services). A Visitor anyhow using the Website and (or) Services unconditionally and irrevocably undertakes to comply with all requirements set out in these Regulations. If the Visitor does not agree unconditionally and irrevocably to assume and comply with all obligations imposed by these Regulations, the Visitor has no right to use any of Services and (or) Websites.

1.3. Trollbeads-Shop.lt has the right at any time to unilaterally modify these Conditions. Modifications of rules take effect after their publication in any of pages of the site-Trollbeads Shop.lt. If a Visitor uses Services after the announcement of modifications of Rules, it will be considered that he agrees with all the changes of Rules. Visitor disagreeing with changed Rules, loses the right to use the Services, as well he must immediately cancel his registration in the Website.

2. Registration and login data.

2.1. Considering the fact that some services (sales, writing comments, and forum participation, etc.) are accessible to the public only after the registration procedure on the website (hereinafter - Registration), the Visitor is free to choose the extent of the services which he can use on the Website

2.2. In order to use or have access to all services available in Website Trollbeads-Shop.lt, the Visitor must accomplish the registration. Registration is made after clicking the link on the Website and filling in all the data requested in the Registration form, including but not limited to, date of birth, full name, home address, e-mail address, password and other information needed to execute the orders and to perform other functions (except when the Registration form states that certain data is not obligatory) (hereinafter - Login). Websites may require an additional registration procedure to use certain services (e.g.in the Website www.Trollbeads-Shop.lt/forum/). The same conditions are applied to such registration procedures as those for Registration. In addition, the site allows Visitors to register with the same login data as in the portal Facebook.com. 2.3. Visitor performing Registration is committed to present only the correct and complete Login data. It is prohibited to make the Registration using borrowed information. Trollbeads-Shop.lt remains the right at its the discretion to decide of the accuracy, fairness and completeness of the Visitor‘s data. In case of  presentation of false, incomplete or inaccurate data Trollbeads-Shop.lt has the right to immediately and without notification to the Visitor remove him from the list of registered persons and (or) take any other actions.

2.4. Visitor unconditionally acknowledges and agrees that he, rather than Trollbeads-Shop.lt is responsible for the confidentiality of login information needed to connect the Visitor to the Website or otherwise using the Services.

2.5. The Visitor is obliged immediately to change and (or) to add Login data that he entered registering in Trollbeads-Shop.lt site if Login data changes. The Parties agree that Trollbeads-Shop.lt performs all its duties and uses its rights in accordance with the presumption that the Visitor's login information is correct and comprehensive. Trollbeads-Shop.lt in any event will be liable for damage caused for the Visitor, and (or) to third parties consequently to the fact that the Visitor entered incorrect and (or) incomplete registration data or did not add login data if it has changed. An example for such a situation would be a situation where Trollbeads-Shop.lt courier fails to deliver the package at the right address, because the in the Website the recipient's changed address was not updated and saved.

2.8. By using the Services and (or) registered in the Website and submitting his data and (or) information to Trollbeads-Shop.lt, the Visitor unconditionally and irrevocably agrees that Trollbeads-Shop.lt manages and maintains any personal data of the Visitor provided or any other information obtained and uses such information on the purpose of this contract, Services provided in a Website, also for direct marketing, statistical purposes and to assess the solvency and (or) on debt management of the Visitor, as well as provide any third parties referred to in Article 2.8 with the Visitors data for this purpose. Visitor agrees that the data of his profile created after the Registration in Website will be available to other Visitors (except for certain details, which the Visitor can restrict the access) and Trollbeads-Shop.lt cannot be considered responsible for usage of such data. Using Services of the Website, the Visitor unconditionally agrees with Privacy Policy of Trollbeads-Shop.lt.

3. Changes of the Website, restriction of the Services.

3.1. Trollbeads-Shop.lt reserves the right at any time without having informed the Visitor, to change the Website and (or) the Services or their separate parts, all and any of their content, functions, any information, including any information provided by the Visitor, etc. Visitor understands and agrees that Trollbeads-Shop.lt will never be held responsible for any of adverse effects caused by these and other similar actions for the Visitor, and refuses to refer any claims for Trollbeads-Shop.lt for such actions.

3.2. Trollbeads-Shop.lt has the right at any time, without notice, for an indefinite period and without giving any reason, suspend or restrict Visitor access to the Website and (or) ability to use the Website Services.

3.3. Trollbeads-Shop.lt has the right to restrict or terminate the provision of services for an indefinite period due to preventive works. In this case, any Visitor using the Services shall be informed about start of the preventive works by the notice (depending on what services Visitors uses - e-mail and (or) some other message) at least one hour before the commencement of works.

3.4. The Parties agree that, Trollbeads-Shop.lt has the right at any time without prior notice completely cancel the whole or any part of the Website activities.

3.5. The Visitor has the right at any time refuse to use the Services by removing his registration data in the manner specified in the Website.

4. Common guidelines.

4.1. Visitor acknowledges and agrees that he, rather than Trollbeads-Shop.lt, is responsible for all and any information, data, symbols, text, software, photographs, images, graphics, video clips, interviews, messages, e-mail , documents or any other materials (hereinafter - Content), sent or in any other ways to transferred using the Website and (or) Services.

4.2. By using the Website and (or) Services, Visitor must comply with any and do not violate the established norms of behaviour and morality, do not violate the statutory requirements and third party rights and legitimate interests, including laws governing intellectual property protection, personal data protection, regulation of advertising etc.

4.3. By using the Website and (or) Services is prohibited to the Visitor:

4.3.1. Use of the Website or the Services in a manner that may endanger the proper functioning of the Website and (or) Services, their security, integrity, or restrict other persons access to the Website and (or) Services;

4.3.2. store, publish, transmit, distribute or in any other way transmit any offensive, defamatory, obscene, pornographic, threatening, abusive, discriminatory or contrary to the legislative requirements Content, as well as any other content that could violate legal requirements, could encourage the behaviour opposite to legislative requirements or causing any legal liability to Trollbeads-Shop.lt;

4.3.3. by any means to distribute links to any Content that may be considered obscene, pornographic, abusive, threatening, abusive, discriminatory or contrary to law;

4.3.4. While registering to select and (or) use the username and (or) e-mail address, which may be considered obscene, pornographic, abusive, threatening, abusive, discriminatory or contrary to law;

4.3.9. Perform more than one Registration in the Website, unless the site requires an additional registration procedure, as well as a Visitor cancels his previous registration data in the manner specified in the Website.

4.4. In addition to the above, the Visitor undertakes not to use the Website and (or) Services:

4.4.1. for any actions that might harm any persons, their property or to perform any legitimate interests;

4.4.2. for the distribution of prohibited by law, defamatory, fraudulent, threatening, infringing the human rights or any other kind of information or Content;

4.4.3. by violating the human rights to intellectual property, including property and copyright, patents, trade secrets or commercial or trademark rights;

4.4.4. for advertising any goods and (or) services, as well as any unsolicited e-mails, messages, messages or other Content distribution.

4.5. The parties agree that if Visitor breaches any of these Rules, Trollbeads-Shop.lt is entitled at any time, in whole or in part to limit Visitor access in any way to use the Website and its services. In this case, the Visitor is returned to the payment paid for the Goods and (or) Services. Visitor agrees that the Trollbeads-Shop.lt unilaterally decides on whether the Visitor breached these Conditions, and undertakes to accept any Trollbeads-Shop.lt decision as a legitimate and fair.

4.6. Visitor understands and agrees that the Goods will be delivered to him, and the service will be provided only after the payment for Trollbeads-Shop.lt for Goods and (or) Services according to order provided on the Website. Trollbeads-Shop.lt has the right to unilaterally change at any time payment for any paid services, and (or) the amount of goods and payment procedures.

4.7. The Visitor understands that part of the Services available on Site is only for adult people. Visitor acknowledges that he is an adult or received permission to use the Website and (or) Services and Goods by his parents, guardians or guardians. Trollbeads-Shop.lt is liable neither materially nor in other forms for such systematic errors because the decision to use such information is made by the Visitor of Website. 5.4. The Visitor realizes that he, rather than Trollbeads-Shop.lt is responsible for any and all Content that a Visitor sends, reviews, keeps or distributes by using the Website or and (or) Services.

5.5. Trollbeads-Shop.lt remains the discretion to remove and replace any Visitor's comments without notifying him.

5.6. By using the Site or the Services and by providing, entering or otherwise introducing the Content, Visitors free of charge, perpetual, unrestricted gives Trollbeads-Shop.lt the following exclusive rights:

5.6.1. right by any form or by any means to reproduce, publish, publish, make available to the public and distribute by selling, renting, lending or other transfer of ownership or management the Visitor's information in any format or language;

5.6.2. the right to create derivative works from the Content provided by the Visitor;

7.1. Visitor agrees that the Trollbeads-Shop.lt is not and will not be responsible for the malfunctions of the Website and (or) Services, and together for the any loss or damage suffered by Visitor or third party.

7.2. Visitor understands and agrees that the Website and the Services are provided without any endorsements or guarantees from Trollbeads-Shop.lt side for the fact that the Website will work, Services will be provided and the Goods will be delivered correctly and on time, without troubles, high quality, full volume or that it will not cause any negative effects for the Visitor or any third party. Trollbeads-Shop.lt is not and will not be responsible for the inconsistencies of the Content on the Website, inaccuracy of information or wrong and the resulting negatively consequences for the Visitor or any third party.

7.3. Trollbeads-Shop.lt shall not be liable for any damages, and (or) losses which may be incurred for Visitor by using the Website and (or) Services and by charging, sending or in any other way transferring or making publicly available any Content.

7.4. Visitor understands and agrees that, Trollbeads-Shop.lt will be not responsible for any form of content that reaches Visitors or other third parties while the Visitor uses the Website and (or) Services, including but not limited to, any errors or inconsistencies in such content, losses or damages caused by the content or the announcement, receipt, transmission of this content or other means of transmission using Services and Goods.

7.5. Visitor understands and agrees that Trollbeads-Shop.lt never for any reason will be responsible for all and any of its acts or omissions related to a Visitor's use of the Site and (or) services, and following these rules. Visitor assumes all responsibility for damages of any kind or damages to which he or a third party may receive by using the Website or the Services.

7.6. The Visitor is committed to ensure that Trollbeads-Shop.lt is prevented from any legal liability, the obligation to pay, reimburse or otherwise compensate for any loss, damage or other costs incurred due to the fact that Visitor uses the Website and (or) Services.

7.7. Trollbeads-Shop.lt liability to Visitor or third parties arising from these rules is limited in the amount of money by the last Visitor has paid for the Paid Services and (or) the Goods - 50 (fifty) LTL.

8. Applicable Law.

8.1. Rules are subject to the law of the Republic of Lithuania.

9. Sending the information.

9.1. Trollbeads-Shop.lt all the notifications, demands, requests and other Visitor information sends to the Visitor by the e-mail address from the Login information of by other means by which the Visitor can be contacted, taking into account the Services used. All in the information sent in accordance with these Regulations shall be treated as received by the Visitor after three hours from the moment the information is being sent.

9.2. Trollbeads-Shop.lt is not responsible for any and all disorders of connection to the Internet, e-mail service providers, networks or other disorders; due to those the Visitor does not receive information or confirmation by e-mails from Trollbeads-Shop.lt. The parties agree that the existence of a copy of an e-mail or other messages for the Visitor in a Trollbeads-Shop.lt server (database or other appropriate information-storing device), is adequate proof of any information transmission to the Visitor.

9.3. All notices, demands, requests and questions to Website Visitors are sending by the contact addresses, given in the "Contact” section.

10. Final guidelines.

10.1. If any guideline of these rules is against the law, or for whatever reason, becomes partially or totally ineffective, it does not void the remaining guidelines of the Rules. In this case, the parties agree to replace the invalid guideline by legally effective rate to the extent possible that would have the same legal and economic result as the modified rule.

10.2. The Parties agree that Trollbeads-Shop.lt may at any time transfer its rights and obligations arising from these Rules to third parties without the Visitor's consent and without informing him.

10.3. The parties agree that these Terms shall take precedence over all the accessible explanations and descriptions for the Visitor in respect of Services, as well as the fact that all disputes between the parties will be resolved in accordance with these Terms.

10.4. All the disagreements among the Visitor and Trollbeads-Shop.lt on the enforcement of these rules shall be settled by negotiation. The parties failing to resolve their dispute through negotiation within 15 (fifteen) days from the date when one of the parties presented a written request to the other party to resolve the dispute, such dispute shall be finally settled in by the accordance with the laws of Republic of Lithuania in the courts of the home or place of residence of the owners of Trollbeads-Shop.lt.
